If the data is not public domain you have to ask the copyright holder (in this case the government) if they allow using their data for OSM.

If you have more questions I suggest you to write at talk mailing list or at the forum because there are more people reading. The password for the OSM Forum is the same as for www.openstreetmap.org.

I don’t think that you’ll get any government data of China.
