Цей житловий масив, як і Кіровський, не є житловими масивами, яким на офіційному рівні присвоєні назви у якості елементів вулично-дорожньої мережі. Згідно закону 3005-IX їм не були присвоєні якісь назви з моменту набрання чинності цього закону (з 28.04.2023). Ці назви використовувались та використовуються. OSM wiki is recommended to use the appropriate tag for gates barrier=gate, for fences barrier=fence.
The essence of the "access" tag is not the presence of barriers, gates, fences or signs (there are appropriate tags for them), but the legality and the presence or absence of the need to obtain a use, pass or driveway permit. In any case, you will see signs and designation that you cross the state border, nearby, but already in the territory of the Russian Federation.

If an area is not controlled by the government, laws are probably not enforced there — that's a fact. Laws and legal restrictions will not always be displayed on the ground — it is not an entity that has a material form. OSM has legal limits that are not posted with signs everywhere, such as the default maximum speed limit in a particular country.

This restrictions are for the general public. The vast majority of people living in this area are well aware of these restrictions and make their own decision to violate the law after 05.06.2014 (at this checkpoint) or not, however, marking this road as "access=yes", where it is explicitly stated that there are no restrictions for the general public, or something different from "access=no" — fraught with administrative or criminal liability for all citizens using for passage these OSM datas with "access=yes" at these "highway=*". I think making the markup such that it promotes breaking the law, especially criminal articles, is not good practice for OSM.

I'm not at this border crossing 24/7, however at the time when I was near this place after 05.06.2014, where one could observe what was happening at this border crossing — the passage was not free, but was carried out by permission of illegal armed groups. Whether it happens to everyone or not is unknown to me, and probably unknown to no one, since no law works there. However, given the feedback from people who have broken the law to cross the border at this location, in the vast majority of cases it is the illegal armed groups who give permission to pass at their discretion.

Yes, in general, illegal border crossing is an administrative offense, if it is proved. There are already a lot of court decisions on bringing to justice persons who crossed the border at this and other closed border crossing points. However, crossing the border can be moved by certain goods, weapons, military equipment, it can be crossed by persons who are in the state or international wanted list such as Interpol, or to which the entry is prohibited — these actions fall under dozens of articles of the Criminal Code of Ukraine and several have already been issued Dozens of decisions to bring persons to criminal liability, where the key factor is the illegal intersection of the state border. I give arguments and sources for "access=no", but member @TesDen doesn't give any arguments, sources and does not argue, periodically making changes to OSM.

I answered in more detail in the changeset you mentioned changeset/159583208. And will await confirmation of the ability to undo the edit changeset/159891315.

The tag "access=no" is defined in the wiki access=* + access=no as denoting inaccessibility for use (including passage or highway=*) by the general public including and primarily due to legal restrictions. At the same time "access=yes" is defined in wiki to indicate the absence of any legal restrictions for the general public.

The "Должанський" border crossing point was closed by protocol decision 05.06.2014 by the Cabinet of Ministers of Ukraine https://www.kmu.gov.ua/news/247368896 and has not been opened since then.

At the moment the border crossing point is on the territory of Ukraine, which is confirmed by the treaty between the Russian Federation and Ukraine on the Russian-Ukrainian state border of 28.01.2003, valid for both sides (https://zakon.rada.gov.ua/laws/show/643_157?lang=en + https://mid.ru/ru/foreign_policy/international_contracts/international_contracts/2_contract/46278/), which came into force on 23.04.2004 after ratification of this treaty by the Russian side (for this border crossing point the points 1228 — 1231 define the state border in this area). Since then, since 23.04.2004, the treaty has not been challenged by anyone, has not been canceled in full, has not been canceled in any part, has not been denounced. Which means that the territory on which this border crossing point is located is on the territory of Ukraine, and the laws, sovereignty and jurisdiction of Ukraine extend to its entire territory according to the Constitution of Ukraine https://zakon.rada.gov.ua/laws/show/254к/96-вр?lang=en (Article 2). Whether there is control over this territory or whether laws are enforced directly on this territory is not what the "access=no" tag determines. The above applies to all border crossing points edited by @TesDen, but for different border crossing points there are different documents of authorized bodies on temporary closure of a border crossing point, as I reported in the comment to my edits and in the message to the first edits of @TesDen for each the border crossing point.

However, given the aggressive personal message from @TesDen, quoted earlier, as well as his comment on the changeset/159064908 edit, it is clear that this participant does not understand what “legal restrictions” and “law” are. Considering that his actions on "highway=*" + "access=yes" markup carry the risk of administrative or criminal liability for those using OSM data — such edits are extremely dangerous for the community.

Related to the above, I ask to issue a caution to the participant, as his actions in terms of editing "access=no" at border crossing points and on the section between the border crossing point and the state border are vandalism: “Purposeful removal or degradation of data that are known to be correct” + “Deliberate adding incorrect data”, and in case of repetition — to block this participant @TesDen.
