well, when you think that path doesn't match, why is footway used for the longer part? For me, path is a way that can be used by foot and one-track vehicles like moped,mofa, bicycle, maybe also by horse riders. The tag highway=virtual sounds might also mean something like
"unbuilt", "not found", "proposed" etc.
Thats why I think that you should not use
an undocumented type for a normal road.

I agree that most of it looks like a track.
The problem is that you have saved a combination of two different road types,
service AND track. That is not valid.
If you think that the complete way is a track, just set highway=track.
If the western part of it is a service road,
then split the way and give each part the correct type.

Or is it given as 40 mph ? In that case
